REGARDING LEGAL INFORMATION:

Heroity provides a fundraising platform that connects heroes with charities for worthy causes. Heroity provides prizes and experiences in effort to help promote the charities and causes. Except regarding the restrictions below; Heroity allows almost anybody to enter a sweepstakes for an equal chance of winning.

Please read all the official rules and information that you need to know before entering any of our campaigns and sweepstakes. These official rules are in place to protect our donors and to make sure everything is fair.

Please note regarding the rules:

– The official rules that are stated in this page apply to every sweepstakes/ campaign; any additional information, requirements or rules for a particular campaign will be stated in the official rules on the campaign page.

– We offer great prizes and experiences to promote charities and their worthy causes in our sweepstakes /campaigns. We hope you’ll consider showing some love and donate to help the cause and to help us expand and offer greater prizes in the future. But you can always enter any sweepstakes /campaigns for free.

– THE CAPITAL LETTERS sections are rules that are required by different laws.

WHEN YOU DONATE TO A PARTICULAR CAMPAIGN /SWEEPSTAKES, YOU WILL RECEIVE AS OUR THANK YOU; ENTRIES INTO THAT PARTICULAR SWEEPSTAKES DRAWING. BESIDES THE PRIZE/ PRIZES THAT ARE REWARDED BY A RANDOM DRAWING/DRAWINGS IN OUR CAMPAIGNS; A CAMPAIGN COULD ALSO INCLUDE GUARANTEED CAMPAIGN PERKS INCLUDED INTO A DONATION TIER. NO PURCHASE NECESSARY TO ENTER ANY SWEEPSTAKES. VOID WHERE OTHERWISE PROHIBITED OR RESTRICTED BY LAW. ALL FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS APPLY.

REGARDING HOW HEROITY WORKS:

Heroity (Corbijn LLC) works with certain Charity /Charities companies for charitable causes. We create campaigns to bring together Charities and Heroes to help raise money for the specific campaign.

Most of the time we will provide the prize or experience but sometimes we will use a Prize Provider (well-known companies, brands, talent and celebrities) who allowed us to use their name and logo for our campaigns.

Prize or prizes that is being offered are ones that almost anyone can enter to win (restrictions apply). Percentage of that money that is raised during our campaigns will go to the Charity. We will also offer guaranteed perks and incentives at times in our campaigns that will be displayed in our donation tiers. The perks and incentives are not part of the sweepstakes, they’re based on donations only.

You are not required to donate to a charity to enter any of our sweepstakes, but we and the charity always appreciate and will give you entries to thank you.

REGARDING ENTERING A SWEEPSTAKES:

Entering a sweepstakes by donating: Visit heroity.com, choose the campaign that interest you and choose the amount tier you would like to donate and pay at checkout. Entering for free: Visit heroity.com, choose the campaign that interest you and email at [email protected]

(Subject Line: add the name of the campaign) (Body of Email: add your name / phone number /email) before the deadline of the sweepstakes.

Entering for free: Click on Back Campaign located on every Campaign Page. It will take you to the cart for $0.00 and you can process your free entry.

REGARDING ENTRIES:

To make things equal which is a priority for us; we give 50 entries into sweepstakes for every free entry (which equals to the entries you get when you donate the minimum $5.00). The maximum number of entries (regardless by donations or free entries) for any one person is restricted to 10,000 entries per person per campaign, unless the specific campaign states otherwise.

Entry By Donating Gives Certain Number Of Entries Per Donation: How ever much you donate by choosing the rewards just times it by 10.

For example: $5 you will receive 50 entries. $25 you will receive 250 entries. $75 you will receive 750 entries. $100 you will receive 1000 entries

All entries is subject to all international, federal, state, and local laws and regulations that is applicable and is void where prohibited. Local rules and laws may restrict or prohibit the award of certain prizes or impose additional restrictions on participation in certain jurisdictions.

REGARDING WHO IS ELIGIBLE TO ENTER A CAMPAIGN:

Most campaigns on Heroity are going to be open to legal residents of the United States, US territories and most countries around the world. All United States list of embargoed countries will be void and not open to our campaigns; including countries where local laws prohibit entry into sweepstakes. If some reason we have to limit certain campaigns to specific countries, it will be published in official rules on the campaign page.

Any employees of Heroity (full-time and part-time), Charity, Prize Provider for the applicable campaign and members of their household including immediate families (parents, spouses, domestic partners, siblings, and children) are not eligible to enter our campaigns and sweepstakes.

Any individual, in any way that provides an unfair advantage over individuals that enter manually including but not limited to a bot, software, or any other codes, instructions or third-party software for the purpose of automatically entering into a sweepstakes (or multiple sweepstakes); will be disqualified from the sweepstakes they entered and all future sweepstakes, subject to Heroity’s sole discretion.

Typically Individuals who have won any Grand Prize in any campaign sweepstakes in the last 12-month period are not eligible to win another Grand Prize until the 12 months period is over. Individuals may only win one prize in a campaign.

At times we may set limitations on how often an individual can be eligible to win more than one Grand or Minor prize within a specified time period. Typically, a “Grand” prize will have an approximate retail value of $600.00 USD or more. Typically, a “Minor” prize is one that has an approximate retail value less than $600.00 USD. But “Grand” and “Minor” can differ in approximate retail value in any of our campaigns.

Some countries allow for an individual to enter sweepstakes but will not allow you to receive or ship a certain Prize. You agree it is your responsibility to review any specific restrictions before claiming that Prize or making a donation. Regardless, all campaigns are void where prohibited by law.

Age can vary from 13 to 18 on who is allowed to enter a certain campaign. Each campaign will inform of the age limit.

Sweepstakes is void in Crimea region of Ukraine (as defined under applicable sanctions), Cuba, Islamic Republic Of Iran, Iraq, Democratic People’s Republic Of Korea, Myanmar, Sudan, Syrian Arab Republic, the Provence of Quebec, and any place where offering the sweepstakes or the awarding of a prize is prohibited. Subject to all applicable laws.

REGARDING THE CAMPAIGN WINDOW:

The Campaign Window of each campaign will start at 12:00:01 A.M. CT (Central Time) unless stated otherwise in the campaign page. The particular start date will be on the campaign page. The Campaign Window of each campaign will end at 11:59:59 CT (Central Time) unless stated otherwise in the campaign page. The particular end date will be on the campaign page.

REGARDING WINNING AND THE PROCESS:

We will use an automated random drawing process to draw a potential winner(s) after 10-14 business days of a campaign close.

Important: We will make 3 attempts to email and call you if phone number is available. If we are not able to reach you after the 3rd attempt, we will choose another winner.

Once a winner is chosen, we will start a confirmation process to make sure the potential winner meets the legal standards required and may require the potential winner to confirm their eligibility; which may include a background check. If a winner is chosen for an event the winner and if applicable, their guest(s) agrees in Heroity conducting any background check(s) and providing information requested by Heroity including, but not limited to, full legal names and addresses. If not fully agreed the prize can be void and we will pick a new winner.

Heroity will conduct any background check, in Heroity’s sole discretion of the potential winner or the potential winner’s guest(s) if the Prize includes meeting a celebrity, meeting a public figure, or attending a special event. It is Heroity’s sole discretion to disqualify said winner and move on to the next randomly drawn potential winner any time ; if at Heroity’s sole discretion that the potential winner or the potential winner’s guest(s) at any time pose a danger to or may harm the reputation of any person or entity involved in the sweepstakes.

Once a confirmation process has been completed and has been approved by the background check, Heroity will contact the potential winner via email and/or phone. The potential winner will have a time frame designated in the notification where the winner must respond to Heroity by the deadline. If for some reason response is not made within the deadline, Heroity may move on to another randomly drawn potential winner. The potential winner and guest(s) will have required documents that must be completed and return to Heroity within the specified time frame.

If some reason all the require documents are not complete and return within the specific time frame to Heroity, you will forfeit the Prize and Heroity may move on to another randomly drawn potential winner. Please be aware that travel companions are also required to sign a liability/publicity release prior to issuance of tickets; travel companions/guests of the winner are required to a background check, which may impact their ability to participate in the prize.

Canadian residents must correctly answer a mathematical skill-testing question to be eligible to be confirmed the Winner.

REGARDING TERM AND CONDITIONS OF PRIZES:

Each Prize description including the approximate retail value for that Prize can be found at the campaign page and in the campaign rules. This would also include any restrictions or conditions that may apply for the prize. Regarding any meetings with celebrities will be subject to security and background checks

Regarding any travel Prizes in the campaigns; unless otherwise specified the airfare will be coach class and any hotel accommodations would be standard class. You must travel on the dates and itinerary specified by Heroity. You will be responsible for gathering all necessary travel authorizations, visas, or other documentation for international travel. All other expenses will be solely your responsibility. This includes any and all expenses not specified in the campaign, including, but not limited to, checked baggage fees, meals and gratuities, are the sole responsibility of the winner and the winner’s guest(s). Be aware that travel restrictions, conditions and limitations may apply when traveling. Because of point of departure, travel dates and fare/rate fluctuations the Prize value may vary. The winner and the winner’s guest must travel on the same itinerary. We may provide ground transportation or a stipend for ground transportation instead if you live within a one hundred (100) mile radius of the site where the Prize is to be performed. Heroity will not be responsible for any cancellations, delays, diversions or substitutions, or any act or omission of any third person. Once they are in your possession, we will not replace lost or stolen tickets, travel vouchers or certificates or similar items. You agree that Heroity and its partners reserve the right to deny or cancel the trip or Prize, in whole or in part, and move on to the next randomly drawn winner if the Prize has not yet been delivered; in the event, in our opinion or the opinion of our partners you or your guest are obnoxious, threatening, abusive, or harassing before or during the trip or Prize.

Your guest must be of legal age of majority in his/her jurisdiction of residence, or your child or legal ward (unless otherwise approved by us). Prizes can’t be transferred or substituted unless otherwise specified in the special campaign rules. Taxes are your responsibility and you have to pay them. All winner with an approximate retail value of $600 or more will be give you a W9 form to fill out so we can issue a Form 1099.

REGARDING WINNER PROMOTIONS:

When accepting the Prize, you agree that we can use your first name and your last name initial, city and state you reside in. You also agree we can use a photograph, video, voice and/or other likeness and Prize information. You agree we can include you in Heroity’s advertising, trade and promotional materials. This includes in any form of media (including media that we may use in the future) and you agree that we can do so without any additional compensation. This only applies unless otherwise prohibited by law.

REGARDING HOW WE USE YOUR INFO:

By choosing to enter any of our sweepstakes, you agree to Heroity’s privacy policy. When you enter in any of our sweepstakes, we’ll collect some information about you that can be shared with our Charities and Prize Providers. REGARDING MORE LEGAL STUFF:

Heroity or Any Sponsor or Any Prize Providers or Any Charities and Any Promotional Partners are not responsible at any time for illegible, lost, late, incomplete, misdirected, or undelivered email.

Heroity or Any Sponsor or Any Prize Providers or Any Charities and Any Promotional Partners are not responsible at any time for any computer, telephone, satellite, cable, network, electronic or internet hardware or software malfunctions, failures, connections, or availability, or garbled, corrupt or jumbled transmissions, service provider/internet/website/use net accessibility, availability, or traffic congestion, or any technical, typographical, or other error.

Heroity or Any Sponsor or Any Prize Providers or Any Charities and Any Promotional Partners are not responsible at any time for unauthorized human intervention, or the incorrect or inaccurate capture of registration information, or the failure to capture, or loss of, any such information.

By entering any sweepstakes, you agree:

– to follow and bounded by the Official Rules, all applicable laws, and decisions of the Sponsor. You agree to which shall be binding, final and non-negotiable.

– to waive any rights to claim uncertainty or not knowing with respect to these Official Rules.

– to waive all your rights to bring any proceedings, claim, or action of any kind against any of the Released Parties in connection with that sweepstakes.

– to forever and irrevocably agree to release, defend, indemnify, and hold harmless each of the Released Parties from any and all claims, lawsuits, judgments, causes of action, proceedings, demands, fines, penalties, liability costs and expenses (including, without limitation, reasonable outside attorneys’ fees) that may arise in connection with your participation in a sweepstakes (including any Prize).

For any event of a dispute in regard to entries received from multiple users having the same email account, only the authorized subscriber of the email account at the time of entry will be considered to be the entrant and must adhere with these rules. The natural person who is assigned the email address by the Internet Service Provider (ISP), online service provider, or other organization responsible for assigning email addresses is the Authorized account subscriber.

REGARDING ANY DISAGREEMENTS OR ANY DISPUTES:

You must agree and adhere that any and all disputes and disagreements between us will be governed by laws of the State of Texas. You must agree and adhere that you will bring any claims only in the Federal and State courts located in Texas. You must agree and adhere that unless you are prohibited from law in doing so, you promise you will bring any and all disputes, claims and causes of action against Heroity individually, without resort to any form of class action. You must agree and adhere that unless the law prohibits you from doing so, you agree to waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages and participants further waive all rights to have damages multiplied or increased.
